Please read this Privacy Notice together with our Terms and Conditions and any product-specific privacy notices or disclosures that may apply to a particular product or service.

1. About Omnipass

Omnipass LLC (“Omnipass”, “we”, “us” or “our”) is a limited liability company incorporated in the State of Delaware, United States. Omnipass operates a digital product distribution and services business through which users may discover, access, register for, subscribe to, purchase or interact with a range of digital products, platforms, content, features and services (collectively, the “Services”).

Some Services are developed, owned or operated by Omnipass, while others may be supplied, operated, fulfilled or supported by third-party providers (“Third-Party Providers”). One of the products that may be made available through Omnipass is Rivalio, which may include sports-related prediction, gaming, entertainment and related functionality.

The capacity in which Omnipass makes a particular Service available, and the privacy practices that apply to that Service, may be further described in the applicable product-specific terms or privacy notice.

2. About this Privacy Notice

This Privacy Notice explains how Omnipass collects, uses, discloses, stores and protects personal information when you visit https://Omnipass.cc/ (the “Website”), create an account, submit information to us, communicate with us, purchase or subscribe to a Service, or otherwise access or use the Services.

For purposes of this Privacy Notice, “personal information” or “personal data” means information that identifies, relates to, describes, is reasonably capable of being associated with, or can reasonably be linked to an identifiable individual, as defined under applicable privacy laws.

This Privacy Notice is intended to describe our privacy practices and is not itself a contract or a blanket consent to processing. Where applicable law requires your consent for a particular activity, we will request that consent separately or as part of the relevant customer journey.

Certain Services may have additional or product-specific privacy notices or disclosures. Those notices apply together with this Privacy Notice and will explain any additional processing relevant to that Service.

Unless the applicable product terms provide otherwise, the Website and Services are intended for persons aged 18 years or older. Certain Services may have a higher minimum age or additional eligibility requirements. We do not knowingly collect personal information from children through Services that are not intended for them. If you believe that a child has provided us with personal information contrary to an applicable age restriction, please contact us using the details below.

7. Personalisation, Profiling, Matching and Advertising

We may analyse and combine information about your use of the Website and Services, your interests, preferences and interactions to personalise Services and content, understand our users, measure engagement, improve products and present or facilitate relevant offers and advertising.

Where permitted by applicable law, we may use personal information or other identifiers to identify or match you or an audience that may include you on digital or social media platforms for the purpose of delivering, measuring or improving relevant or personalised advertising. Those platforms may process information in accordance with their own privacy notices.

Where applicable privacy law gives you a right to opt out of targeted advertising, the sale of personal data, certain sharing of personal data, or qualifying profiling, you may exercise that right using the methods described in the “Your Privacy Rights” section below.

8. Artificial Intelligence and Automated Tools

We may use artificial intelligence, machine learning and other automated tools to support the operation and improvement of our business and Services. Depending on the Service, these tools may assist with functions such as personalisation, recommendations, customer support, fraud and abuse detection, analytics, content moderation, marketing optimisation and operational efficiency.

We may use personal information as an input to such tools where reasonably necessary for these purposes and permitted by applicable law. Where a Service uses automated processing in a way that requires a specific notice, consent or opt-out right under applicable law, we will provide the relevant information and choice.

9. De-identified, Aggregated and Anonymised Information

We may de-identify, anonymise or aggregate personal information so that it can no longer reasonably be linked to you. We may use and disclose such information for analytics, research, product development, business intelligence, security, statistical and other lawful purposes. Where information is maintained in de-identified form, we will not attempt to re-identify it except where permitted by applicable law, including where necessary to test whether our de-identification processes are effective.

Where a Third-Party Provider independently determines how it processes personal information in connection with its own product or service, its privacy notice will also apply. You are encouraged to review the privacy practices of any Third-Party Provider with which you interact.

11. Direct Marketing and Communications

Where permitted by applicable law, and subject to any required permission or consent, we may contact you by email, text message, telephone, push notification or other electronic channels about Omnipass, the Services, product updates, promotions, offers and other information that may interest you.

You may opt out of promotional emails by using the unsubscribe link in the message, if applicable, and/or you may use any other opt-out mechanism provided in the relevant communication. You may also contact us using the details below.

Opting out of marketing communications does not prevent us from sending transactional, security, account, legal or service-related communications where permitted or required.

12. Cookies and Similar Technologies

We and our service providers may use cookies, pixels, local storage, software development kits and similar technologies to operate the Website and Services, remember preferences, understand usage, maintain security, conduct analytics and, where permitted, support advertising and personalisation.

Some of these technologies are necessary for the Website or Services to function. Others may be optional. Where required by applicable law, we will provide you with choices regarding non-essential cookies or similar technologies.

You can also control certain cookies through your browser settings. Disabling cookies may affect the availability or functionality of parts of the Website or Services.

13. Security

We use reasonable administrative, technical and organisational safeguards designed to protect personal information against unauthorised access, acquisition, loss, misuse, alteration or disclosure, taking into account the nature and sensitivity of the information and the circumstances of its processing.

No system or transmission method can be guaranteed to be completely secure. You are also responsible for keeping your account credentials confidential and notifying us promptly if you suspect unauthorised use of your account.

14. Data Retention

We retain personal information for as long as reasonably necessary for the purposes for which it was collected or otherwise processed, including to provide the Services, maintain business and transaction records, comply with legal obligations, resolve disputes, enforce agreements, prevent fraud and protect our rights.

Retention periods may vary depending on the type of information, the Service involved, the nature of our relationship with you, legal requirements and legitimate business needs. When personal information is no longer required, we may delete, destroy, anonymise or de-identify it in accordance with applicable law.

15. Your Privacy Rights

Depending on where you live and the privacy laws that apply to Omnipass, you may have rights in relation to your personal information. These may include the right to:

  • Confirm whether we process personal information about you and access that information.
  • Correct inaccuracies in your personal information.
  • Request deletion of personal information, subject to applicable exceptions.
  • Obtain a copy of personal information you previously provided to us in a portable format where applicable.
  • Opt out of targeted advertising, the sale of personal data, certain sharing of personal data, or qualifying profiling where applicable.
  • Withdraw consent where processing is based on consent, without affecting processing already lawfully undertaken.
  • Appeal a decision we make in response to a privacy rights request, where applicable law provides an appeal right.

To exercise an applicable privacy right, please contact us using the details in the “Contact Us” section below or use any privacy request mechanism made available on the Website. We may need to verify your identity before completing a request. We will not discriminate against you for exercising a privacy right available to you under applicable law.

If we deny a request, we will provide information about any available appeal process where required by applicable law. Delaware residents whose request is denied may also have the right, where the Delaware Personal Data Privacy Act applies, to contact the Delaware Department of Justice regarding a complaint.

16. Third-Party Websites and Services

The Website and Services may contain links to, or integrations with, websites, platforms, products or services operated by Third-Party Providers. Omnipass does not control the independent privacy practices of those third parties. Information you provide directly to a third party, or that the third party independently collects from you, will be processed under that third party’s privacy notice.

A link or integration does not, by itself, mean that Omnipass endorses the third party’s privacy or security practices. We encourage you to review the relevant third-party privacy notice before providing personal information.

17. Changes to this Privacy Notice

We may update this Privacy Notice from time to time to reflect changes to our Services, business practices, technologies or legal requirements. We will post the updated Privacy Notice on the Website and update the “Last updated” date above.

Where required by applicable law, we will provide additional notice or obtain consent before any material change takes effect.
